What SongRise Does

SongRise creates personalized affirmation songs using your voice. Here's how:

1. You record 60 seconds of yourself singing.
2. We send your voice recording to Mureka AI, a third-party AI service, which creates a digital clone of your voice.
3. Our AI generates personalized affirmation lyrics based on your goals.
4. Mureka AI generates songs using your cloned voice and those lyrics.
5. You receive your songs as MP3 files.

Everything is AI-generated. No human performers sing your songs. The voice in your songs is an AI reproduction of your voice, not an actual recording of you singing.

Your Voice, Your Consent

When you record your voice on SongRise, you confirm that:

• The voice in the recording is yours. You are the person singing in the clip.
• You consent to AI voice cloning. You understand your voice recording will be sent to Mureka AI to create a digital voice clone.
• You understand how your voice will be used. Your cloned voice will be used solely to generate affirmation songs within SongRise.

We take this seriously. Your voice is personal. We will never use your voice clone for anything other than generating songs you request within SongRise.

Third-Party AI Processing

Your voice recording and song generation are processed by Mureka AI (mureka.ai), a third-party artificial intelligence provider. Your 60-second voice recording is transmitted to Mureka AI's servers for voice cloning, and song generation requests are sent to Mureka AI, which returns generated audio files.

This disclosure satisfies Apple App Store Guideline 5.1.2(i). Your voice data is shared with Mureka AI before any AI-generated content is created. You will be asked to acknowledge this before your first voice recording.

Who Can Use SongRise

• You must be at least 13 years old to use SongRise.
• If you are between 13 and 17, you need a parent or legal guardian's consent.
• You must be at least 18 years old to purchase a subscription, unless a parent or legal guardian completes the purchase on your behalf.

What You Own

You own your generated songs. When SongRise creates a song for you, you receive a personal, non-exclusive, perpetual license to use that song for any personal, non-commercial purpose. You can listen, share with friends and family, post on social media, and use them as personal motivation.

You cannot sell them, license them to others, distribute them commercially, or use them in commercial products without our written permission. You don't own the underlying AI model, voice cloning technology, or song generation system.

Subscriptions and Payments

Subscriptions are billed through Apple In-App Purchase or Stripe (for web purchases). Your subscription automatically renews unless you cancel. Prices may change with 30 days' notice.

Cancellation: Cancel anytime through your Apple ID settings or SongRise account settings. Cancellation takes effect at the end of your billing period. Songs already generated remain yours.

Refunds: App Store purchases follow Apple's refund policy. Web purchases can be refunded within 7 days if no songs were generated. Single song purchases are non-refundable once generated.

Things You Cannot Do

• Upload someone else's voice. Every voice recording must be your own voice.
• Use SongRise for impersonation. No deepfakes or misrepresentation.
• Use generated content to harass, threaten, or harm others.
• Reverse engineer or attempt to extract the AI models or proprietary systems.
• Circumvent usage limits through automation, bots, or scripts.
• Use SongRise for any illegal purpose.

Deleting Your Account and Data

Delete your account anytime from within the app or by emailing privacy@songrise.app. We delete your voice recording, voice clone, all generated songs, and account information. Deletion is permanent, processed within 30 days. Some data may persist in encrypted backups for up to 90 days.

Service Availability

SongRise depends on third-party AI services. We do our best to keep the service running but cannot guarantee uninterrupted availability, specific voice clone accuracy, or that features won't change. If we discontinue the service, we will give you at least 30 days' notice and the ability to download your songs.

Limitation of Liability

SongRise is provided "as is" without warranties. We are not liable for indirect, incidental, special, consequential, or punitive damages. Our total liability is limited to the amount you paid us in the 12 months before the claim arose, or $50, whichever is greater. This doesn't affect consumer protection rights that cannot be waived.

Indemnification

You agree to defend and hold harmless Downshift LLC from any claims arising from your violation of these terms, misuse of voice recording features, or content you create or share using SongRise.

Dispute Resolution

Disputes are resolved through binding arbitration under the American Arbitration Association rules, except for intellectual property claims. Class actions and class arbitrations are not permitted. EU residents retain the right to bring claims in local courts.

Changes to These Terms

We may update these terms. For material changes, we'll notify you at least 30 days before they take effect. Continuing to use SongRise after changes means you accept the new terms.

Governing Law

These terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
